چکیده

خانواده از اساسی‌ترین بنیان‌های جامعه اسلامی است و حفظ آن اهمیت فراوان دارد. گاهی در میان خانواده تعارضاتی پیش می‌آید که از دیرباز توصیه‌های اخلاقی نسبت به گذشت و مدارا در متون دینی ملاحظه می‌شود. اما سوال مهم در این جا وجود دارد که در آثار فقهی گذشته به آن اشاره‌ای نشده است. آیا فقه امامیه برای افراد خانواده در این تعارضات، وظیفه‌ای فقهی مشخص کرده است؟ باید برای حل این مسأله، مسائل دیگری مانند بحث ضرر، اقسام ضرر، تعارض ضررها و تزاحم به عنوان مبانی بحث مورد بررسی قرار گیرد. این تحقیق با روش تحلیلی و توصیفی به بررسی ادله و نظریات فقهاء به کشف وظیفه شرعی افراد با تاکید بر وظیفه پدر نسبت به تربیت فرزند پرداخته و تکلیف فقهی را معین کرده است. صورت‌های مختلفی در مسأله وجود دارد که می‌توان از تعارضات ناشی از مسائل دینی، اختلاف سلایق و تعارضات منجر به تضییع حقوق دیگران را نام برد.

چکیده [English]

Family is one of the most basic foundations of Islamic society and its preservation is very important. Sometimes there are conflicts in the family, which have long been considered ethical recommendations for forgiveness and tolerance in religious texts. But there is an important question here that has not been mentioned in the past jurisprudential works.Has Imami jurisprudence defined a legal duty for family members in these conflicts? In order to solve this problem, other issues such as the discussion of losses, types of losses, conflicts of losses and conflict should be examined as the basis of the discussion. Using analytical and descriptive methods, this research has examined the evidences and theories of jurists to discover the Shariah duty of individuals with emphasis on the father's duty to raise the child and determined the legal duty.There are different forms in the problem, which can be mentioned as conflicts caused by religious issues, differences in tastes, and conflicts leading to the violation of the rights of others.
