Abstract
Emigration is one of the important cultural teachings of Islam that aims to promote and bring about virtue and excellence. The Holy Quran has promised many worldly and otherworldly effects on it. In this regard, Muslim jurists have analyzed the relevant verses and hadiths and have come to the conclusion that emigration is obligatory on the duty-bound in certain circumstances. Under this issue comes the issue of the emigration of children which the jurists firmly believe to be unnecessary. Some jurists, citing the Holy Qur'an, have stated that the rule of emigration also applies to children below the age of puberty. The present research has examined the question: "What is the duty of non-adult children in the face of this jurisprudential ruling in the event of the necessity of emigration for the duty-bound people?" This research has explored the mentioned question using inferential analysis and the obtained results have shown that the Quranic evidence presented by those who believe in the necessity of migration is incomplete and insufficient, but the author relying on a rational analysis claims that in one case, it is obligatory on the non-adult child to migrate and that is when one considers it rationally likely that he will not be able to emigrate after puberty. Therefore, the well-known position that emigration is not obligatory on children before the age of puberty is not valid either.
