Abstract

In recent years, the permissibility of marriage for minor girls from the Islamic perspective has been a topic of discussion among researchers and in public discourse, including social media. Sometimes, it is suggested that Islam permits the marriage of minor girls by their guardians without any restrictions. These laws are based on human rights principles or derived from secondary titles, which prohibit their marriage until they reach intellectual and physical maturity. This perception can be seen as a serious objection and weakness in Islamic legal schools.
This article examines this issue using a descriptive-analytical method and by collecting information through library research. The belief in the impossibility of overcoming the adverse educational consequences of a legal ruling, alongside a special approach to the conditions of time and place in jurisprudence and attention to the tangible aspects of the concepts of interests and harms, paves the way for presenting new opinions in this area that align with the educational goals of the Shari'ah. The conclusion is that in the current era, considering the adverse educational consequences and the conditions of the time, such marriages are mostly harmful and prohibited, except in very specific cases where the guardian can prove the existence of interests and positive educational aspects of marrying a minor girl in court.
