Abstract
Divine rulings regarding the actions of the obligated are part of Islamic jurisprudence, encompassing both primary and secondary rulings. Primary rulings, in jurisprudential terminology, are also referred to as inherent rulings. These rulings are issued based on benefits and harms and are characterized by stability. Secondary rulings are based on titles such as coercion, necessity, hardship, and precaution, and are generally formulated considering the circumstances affecting the subject, which, when the incidental titles are removed, the secondary legal ruling is also lifted. Mourning for Imam Hussein (PBUH) is a living educational school of Islam and Shiism, rooted in divine obligations, including the necessity of honoring divine rituals. Qama-zani is one of the mourning practices for Imam Hussein (PBUH). There is a dispute regarding the jurisprudential ruling of "permissibility" due to the fulfillment of the criteria for honoring rituals or "prohibition" due to its derogatory implications for religion and sect. The research question is: What is the ruling on establishing divine rituals in qama-zani from the perspective of jurisprudence and education? The main arguments for those who advocate for inherent prohibition are based on two jurisprudential principles: "No harm" and "Negation of hardship." However, a critique of the above principles reveals their inadequacy and lack of relevance to the inherent prohibition of qama-zani. Nevertheless, the prohibition of qama-zani based on secondary rulings (derogation of the Shari'ah and sect) and its negative educational impacts cannot be denied.
