چکیده

عدالت به‌معنای نهادن هر چیز در جایگاه خود، از والاترین ارزش‌های انسانی و اصلی‌ترین مبانی حقوق و اخلاق است که در تمام شئون زندگی، از جمله خانواده حضوری برجسته دارد. این پژوهش با هدف بررسی ماهیت عدالت و کاربرد آن در خانواده، از منظر فقه اسلامی تلاش کرده است تا مفهوم عدالت را در چارچوب اخلاق و شریعت تحلیل کند. عدالت به‌عنوان یک اصل اخلاقی و خصلتی حق‌طلبانه، محور احقاق حقوق و ماندگاری نظام خانواده است. در این راستا، مفهوم عدالت در خانواده به‌ویژه در زمینه مشکلات مربوط به رعایت عدالت میان همسران تحلیل شده است. یافته‌های این تحقیق نشان می‌دهد که از منظر فقه اسلامی، اجرای عدالت در روابط خانوادگی مستلزم رعایت حقوق مالی، عاطفی و اخلاقی اعضای خانواده است و عدل در چندهمسری نیازمند پایبندی به شرایطی خاص است که به‌دلیل پیچیدگی‌های اجتماعی و اخلاقی، تحقق آن با دشواری‌هایی همراه است. این مقاله به‌روش توصیفی‌تحلیلی انجام شده و به تقویت گفتمان عدالت‌محور در خانواده‌های اسلامی پرداخته است.

چکیده [English]

Justice, defined as placing everything in its rightful place, is one of the highest human values and fundamental principles of law and ethics, with a prominent presence in all aspects of life, including family. This study aims to explore the nature of justice and its application in the family from an Islamic jurisprudential perspective, analyzing the concept of justice within the framework of ethics and Sharia. Justice, as a moral principle and a claim for rights, is central to securing rights and maintaining the family system. The study focuses on justice within the family, particularly regarding the challenges of maintaining fairness between spouses. Findings show that, from an Islamic jurisprudential standpoint, the implementation of justice in family relations requires upholding the financial, emotional, and ethical rights of family members. Justice in polygamy demands adherence to specific conditions, and due to social and ethical complexities, achieving it is challenging. This article is a descriptive-analytical study that contributes to strengthening the justice-centered discourse in Islamic families
